Nesar Ahmad Mohammadi, Teaching Assistant Abdul Basir Nasiri and Dr Sayed Yadullah Gowhari compare the conflict-of-laws rules on personal status in Iran and Afghanistan, addressing marriage, divorce, parent–child relations, guardianship, tutorship and legal capacity. Their findings indicate that both systems predominantly treat nationality as the principal connecting factor in personal-status matters, while differing in its scope, judicial interpretation and the mechanisms used for contemporary cross-border disputes. The authors conclude that growing international mobility and complex family relationships require a more flexible approach that gives greater weight to factors such as habitual residence and the best interests of vulnerable persons.
