Tamás György Sveda’s art­icle in Magyar Jog, the second part of a two-part study, ad­dresses the still-unresolved ques­tions sur­round­ing ar­bit­rat­ors’ li­ab­il­ity in dam­ages under Hun­gari­an prac­tice. The author shows how, in ar­bit­ra­tion with an in­ter­na­tion­al ele­ment, private in­ter­na­tion­al law rules can be used to de­term­ine the ap­plic­able law and jur­is­dic­tion in a claim against an ar­bit­rat­or, and also dis­cusses the con­tested Hun­gari­an case-law on the legal basis of li­ab­il­ity, re­cov­er­able heads of damage, per­son­al injury claims and the pos­sible use of li­ab­il­ity in­sur­ance.
