Luis Bolívar Marín Carangui and Ana Fabiola Zamora Vázquez address how Ecuador should determine the applicable law where a deceased person had nationality or domicile connections with more than one State. They describe the existing framework as fragmented across the Civil Code, the Bustamante Code and general private international law principles.
The qualitative study combines doctrinal, normative and comparative analysis, focusing in particular on Argentine law and Regulation (EU) No. 650/2012. It finds that traditional connecting factors, including the deceased’s nationality and the fragmentation of the estate, no longer adequately address contemporary cross-border successions, and proposes reform centred on habitual residence, unity of succession and the deceased’s autonomy of will.

The article clarifies the fragmented framework governing successions in Ecuador involving multiple nationality or domicile connections. Its comparative proposal shifts the reform discussion away from nationality-based connecting factors towards habitual residence and the unity of succession.
