Alan Khee-Jin Tan’s article in Air and Space Law examines third-, fourth- and fifth-freedom traffic rights under ASEAN’s regional open-skies regime. It states that some Member States have restricted fifth-freedom passenger services, particularly operations that are not geographically linear, and connects those restrictions with limitations in recent multilateral agreements concluded by ASEAN with China, the European Union and New Zealand.
