Commentary on extramarital paternity and surname determination in registration in surrogacy cases
Development summary
Aurora Hernández Rodríguez considers the establishment of non-marital paternity for a child born in Prague through surrogacy, the determination of surnames on registration of the birth in the Spanish Civil Register, and the restricted-publicity regime. The article comments on Bizkaia Provincial Court judgment no. 559/2025 of 19 September 2025, which allowed the public prosecutor’s appeal against the Bilbao Court of First Instance No 2’s decision fully granting a Spanish national’s claim for paternity and registration of the child with the father’s two surnames. The gestational mother, who was also the legal mother under Spanish law, had renounced rights arising from maternal affiliation and sought application of the restricted-publicity regime under civil-registration legislation.
