Ziqing Diao compares the system governing the extraterritorial application of Chinese trademark law with American rules. The article reviews the legal basis and development of rules on the extraterritorial application of domestic law in the United States, together with the adjudicative standards and operational mechanisms for the Lanham Act’s extraterritorial application. It assesses legislative, judicial and enforcement gaps, controversies and practical shortcomings in China, and proposes legislative improvement, standardised enforcement, judicial guidance and strengthened specialist capacity.
