The article by Katie Chung and Michael Hwang, published in the Journal of International Arbitration, reviews international law on confidentiality in arbitration in theory and practice, including national legislation and institutional rules. It argues that the principal difficulty lies in defining exceptions to the duty of confidentiality where that duty is recognized, and examines the New Zealand Arbitration Act 1996, as amended in 2007, as an attempt to codify those exceptions.
