Determination of the Applicable Law to Maritime Liens
Development summary
This article addresses the question of which law governs maritime liens granted to maritime claims under the Turkish Commercial Code. It first explains the substantive-law character of the right and notes that, save for the statutory exceptions, it takes priority over other liens and proprietary burdens on the ship. For disputes with a foreign element, it states that the special provisions of the Turkish Commercial Code, the Private International Law and Procedural Law Act (MÖHUK), and the relevant international conventions are to be taken into account.
