Why does it matter?
The article shows that cross-border bank guarantees involve more than one contractual relationship: the relationships between the issuing bank, the beneficiary and other banks, together with claims connected to the underlying transaction, require separate consideration. Its framework enables the applicable law in guarantee transactions to be assessed alongside the effects of public policy and overriding mandatory rules.
