Eapil working group report on the transposition of the EU Anti-SLAPP Directive
Development summary
The EAPIL Working Group on Anti-SLAPP Directive Transpositions held its fourth meeting on 4 June 2026, chaired by Birgit van Houtert and Marco Pasqua, after the 7 May 2026 transposition deadline had passed. The session brought together contributions from Slovenia and France on national transposition approaches through a case study and examined how SLAPPs are identified, whether national measures extend to domestic and criminal settings, the jurisdictional basis for bringing a compensatory claim in the claimant’s Member State, possible grounds for refusing recognition and enforcement of a third-country judgment, and the operation of the Directive’s early dismissal mechanism.
