Sinan Can Konyali’s art­icle, pub­lished in De­hukam Deniz Hukuku Dergisi on 20 Decem­ber 2024, starts from the ab­sence of any ex­press con­nect­ing rule for de­term­in­ing the law ap­plic­able to gen­er­al av­er­age dis­putes with a for­eign ele­ment. It ex­am­ines which law should govern the gen­er­al av­er­age status, the status of ad­just­ment and lim­it­a­tion peri­ods, and wheth­er the gen­er­al av­er­age con­tri­bu­tion gives rise to a mari­time lien, while also as­sess­ing the conflict-of-laws po­s­i­tion of ref­er­ences to the York-Antwerp Rules and ad­just­ment, and it pro­poses a spe­cial con­nect­ing rule to fill that gap.
