Response of the German Judges Association to the HCCH draft text on parallel proceedings and related actions
Development summary
The German Judges Association’s response to the HCCH draft text for a future convention on parallel proceedings and related actions has been published. While supporting an international instrument on parallel proceedings in principle, the Association considers that the ‘more appropriate court’ test in Articles 9 and 10 could expand judicial discretion and weaken the predictability of jurisdictional rules. It favours a more rule-based solution that gives priority to the court first seised.
