Some Considerations on the Law Applicable to the Legal Liability of Physicians in the Scope of Health Tourism
Development summary
This article by Güven Yarar and Sezgin Karma, published in Akdeniz Üniversitesi Hukuk Fakültesi Dergisi, addresses the law applicable to disputes arising from the relationship between self-directed health tourists coming to Türkiye for treatment and an independent physician. It states that, where a foreign element is present, conflict-of-laws rules determine the applicable law; the study is confined to disputes based on a medical contract and excludes package-tour arrangements, which are covered by a separate legal regime.
