The Law Applicable to the Determination and Change of the Names of Natural Persons in Belgian Law and Some Recommendations from the Perspective of Turkish Law
Development summary
The article examines the law applicable to the determination and change of the names of natural persons in Belgian private international law, in the light of the 2017 amendments to the Belgian Code of Private International Law and recent case law. It highlights, in particular, the introduction of party autonomy for Belgian nationals with multiple nationalities in name determination, and compares this with Turkish private international law, where no specific rule governs names and the applicable law is instead derived from the legal act or relationship underlying the matter.
