The Permanent Bureau of the Hague Conference on Private International Law announced a new and revised edition of the Explanatory Report on the Convention concerning the international protection of adults. It replaces the previous edition, including the version reproduced in the offprint of the proceedings of the Special Commission with a diplomatic character held in 1999, and also corrects a few typographical errors.
A revision to paragraph 146 by the Rapporteur, Professor Paul Lagarde, expressly clarifies that confirmation of a power of representation by a competent authority may constitute a measure of protection under the Convention. The issue was discussed during the Convention’s negotiations and was subsequently raised by authorities and experts seeking clarification; the revised edition provides that clarification, and a corrigendum will also be added to the 1999 Special Commission proceedings.
