Holding foreigners excluded from temporary protection without a detention order: A de facto deprivation of liberty
Development summary
Neva Övünç Öztürk and Bariş Teksoy examine, in light of the right to liberty and security, the practice of holding foreigners excluded from temporary protection under Article 8(3) and (5) of the Temporary Protection Regulation in temporary accommodation centres or places designated by governorships without an administrative detention order. Although the exclusion decision is notified to the person concerned, the authors note that no written, reasoned and reviewable decision is required for the holding itself, which is not linked to the administrative detention provisions of Law No. 6458.
