Private international law review of international surrogacy arrangements and China’s policy response
Development summary
International surrogacy has expanded alongside medical technology and the differing rules that states apply to surrogacy and legal parentage, giving rise to cross-border disputes. This article approaches the subject from a private international law perspective, considers China’s existing prohibitive policy, and reviews the Hague Conference on Private International Law’s work together with Chinese legal and judicial practice to assess how China may respond in policy and legislation and how it may position itself towards international parentage and surrogacy arrangements.
